This is the headline at talkingpointsmemo.com. I don't know why it isn't the headline at the NY Times and the Washington Post and everywhere else. It’s certainly accurate. The Supreme Court is granting itself powers not anticipated by the framers, who thought Congress and the executive branch had a role to play.

@JamesGleick I live in California where conservatives in other states have challenged CA authority to impose regulations explicitly spelled out in laws such as Proposition 12, light duty zero emission and state air pollution restrictions. Flimsy regulation at the federal level will mean more regulation at the state and local level in CA. Which is fine, D.C. is a long way from here and we prefer to work things out on our own anyway. It will be interesting though to see how SCOTUS handles those kinds of cases going forward. Also without federal or state regulations and state laws that restrict damages in tort cases some conservative states are now legal free for alls, they will be giant magnets for bad actors. Those residents are in for a rough time and will have only their governors and state law makers to turn to for help - good luck with that.
